GENERAL CONDITIONS OF BICACHAIR

These General Conditions are intended to regulate the terms and conditions by which BURN Lda, a collective person with VAT number 513504729 with headquarters at Rua Pinto Bessa 522, Rc Esqº in Porto (hereinafter “BICAchair”) will be governed.

BICAchair's service consists of making available and supplying a set of products and/or services, in order to allow the user, to whom the status of customer is attributed, to order and purchase online the products presented therein.

By using the BICAchair website, it implies acceptance and full agreement with all parameters present in the Terms and Conditions described, as well as the Privacy Policy in force at the time you access BICAchair.

If you do not accept, in part or in full, any of the stipulated conditions, you should not make purchases through the BICAchair website. If you access the BICAchair website, you are committing yourself and being responsible for respecting the conditions determined on this page and in the Privacy Policy.

BICAchair reserves the right to update and modify the Terms and Conditions without prior notice. It is advisable to periodically check the Terms and Conditions for any changes or updates.

BICAchair informs customers about the features, descriptions, images or videos of each product and/or service on each available page. BICAchair is committed to making its products and/or services available in a clear manner and correcting possible errors that may occur as soon as possible. 

BICAchair presents, in a concise manner, the prices of each product and/or service, including VAT rates, shipping costs applied to each order and other additional costs that may be applicable.

Information about products, prices, contents, images, videos, promotional campaigns and services can be updated and changed by BICAchair at any time.

BICAchair is a registered online store, and the service provided is the responsibility of BURN lda.

The content, domain, information present and made available on BICAchair are the property of BURN lda or have been granted to it, and are therefore protected by copyright and related rights. Any and all use, reproduction, copying or dissemination of visual, audiovisual or written content is subject to prior approval by BICAchair.

The customer undertakes to fully respect the aforementioned conditions and rights, as well as to refrain from acts that may go against the law and rights such as copyright, related rights, among other laws applicable to the use of images, videos, content, etc. without the express approval of BICAchair. BICAchaircannot be held responsible for any misuse of such products.

After payment is completed, BICAchair will proceed with a standard check, so that the order con be processed and shipped. The customer will receive an email confirming that the order has been paid, as well as the corresponding invoice.

 

BICACHAIR  PURCHASE CONDITIONS:

Product availability

All products and/or services available at BICAchair can be purchased, except in cases of shortages or stock limitations, as well as products made to order, whose availability may vary. Products may become unavailable without prior notice, but in these circumstances, they will be duly identified on BICAchair.

In case the product is no longer available after the purchase has been completed, BICAchair undertakes to contact the customer, by telephone or email, as soon as possible in order to speed up the process with them.

 

Fees and taxes

At BICAchair, the prices shown are in Euros, with the applicable VAT and tax rates being applied in accordance with the current law, which are not included in the prices shown. All our prices are tax-free so they do not include the VAT.

 

ORDER CANCELLATION

The customer may cancel an order placed while it is being processed. You are requested to inform BICAchair through the following e-mail contact: support@bicachair.com

The cancellation request can never be made after the order has been shipped, it will be sent for delivery and the customer can choose to refuse to accept it. BICAchair is not responsible for possible delays in handling order cancellations.

BICAchair reserves the right not to process orders or refunds in cases of data inconsistency, fraud or customer misconduct, as well as for technical issues beyond BICAchair's control.

 

FREE RESOLUTION

The customer has the right to rescind the order within 14 (fourteen) days from the contract award date. If the customer wishes to terminate the contract, he may do so via the email support@bicachair.com

 

When terminating the contract within the legal period, in addition to returning the money, the customer must return any gifts that accompany the main product. BICAchair must refund the amount paid within a maximum period of 14 days after receiving the email accompanied by the purchase invoice, proof of payment and return form.

The refund will be made through the same payment method used by the customer in the initial payment, except in situations of express agreement and in which the customer does not incur any costs as a result of the refund.

Any refund procedure will be processed as provided for in the legislation in force in Decree Law n.º 24/2014.

DISCLAIMER

When creating and using the account at BICAchair, the customer is responsible for maintaining the account, confidentiality and for all activity arising from his account. When creating the user account and placing orders, the customer expressly and unequivocally accepts the Terms and Conditions in their most up-to-date version.

BICAchair is not responsible for any information disclosed by third parties, technical failures or any other problems that prevent access and proper functioning of the online store.

BICAchair is not responsible for possible damages, directly or indirectly related to the use, or inability to use, the products and/or services made available, as well as for any delay or unforeseen occurrence in the delivery of orders.

APPLICABLE LAW - JURISDICTION

This contract is subject to Portuguese law and legislation in force.

Any disputes which may arise from or in connection with the contract will be decided under the jurisdiction of the Commercial Court of Porto.
